http://www.thuvienso.info Sau thời kỳ dài của đêm trường Trung cổ, nhu cầu về thiết lập một trật tự xã hội mới với nền tảng cơ bản là giải phóng con người, tôn trọng quyền tự do của con người đặt ra hết sức gay gắt... Các nhà tư tưởng khai sáng đã xuất hiện và các ông đã có những công trình triết học, văn học, pháp luật, xã hội học..., nhằm hướng tới xây dựng một xã hội “tự do, bình đẳng, bác ái”. Montesquieu (1689 - 1755) và Rousseau (1712 - 1778) nổi lên với tư cách là hai nhà tư tưởng có những ảnh hưởng rất lớn đến cuộc cách mạng tư sản Pháp nói riêng và nền văn minh thế giới nói chung. Hai tác phẩm: Bàn về tinh thần pháp luật (1748) của Montesquieu và Bàn về khế ước xã hội (1762) của Rousseau ra đời, trở thành bộ đôi tác phẩm có ý nghĩa khai sáng về quan điểm pháp chế, vạch ra định hướng xây dựng xã hội công dân, nhà nước pháp quyền, mở đường cho tư duy xã hội Pháp đi tới cuộc đại cách mạng tư sản năm 1789. Nhiều quan điểm trong hai tác phẩm này đã trở thành những nguyên tắc pháp lý chi phối sâu sắc đến sự phát triển của nhà nước và pháp luật hiện đại.
Hai tác phẩm ra đời đúng vào thời điểm mà tư tưởng cách tân bị ngăn cản, cấm đoán bởi các thế lực phong kiến hủ bại và thần quyền đương thời. Nhưng các tác giả đã dũng cảm thể hiện thái độ và tinh thần xây dựng tích cực của mình trước hiện thực xã hội. “Bàn về tinh thần pháp luật” đã đề cập và lý giải hàng loạt vấn đề luật học cũng như các khoa học xã hội đương thời; phân tích so sánh các nội dung và bản chất của các thể chế chính trị khác nhau, chỉ ra nhiều điểm hạn chế và tích cực của từng thể chế; bàn về các yếu tố liên quan đến luật, cách soạn thảo luật và ứng dụng luật trong các lĩnh vực xã hội...
Bàn về khế ước xã hội cũng đề cập những vấn đề nêu trên nhưng đi theo hướng tư duy hoàn toàn khác: Nếu như Montesquieu muốn khám phá cái “trật tự, cái quy luật trong mớ hỗn độn các luật pháp ở mọi xứ sở và mọi thời đại” thì Rousseau lại cố gắng tìm kiếm trong cái “trật tự dân sự có hay không một số quy tắc cai trị chính đáng, vững chắc, biết đối đãi với con người như con người”; nếu như Montesquieu dùng phương pháp quy nạp trên cơ sở khảo sát, phân tích đặc điểm từ tự nhiên đến xã hội và các chính thể để rút ra các nguyên tắc chi phối chúng, thì Rousseau đi từ những nguyên tắc chung để đưa ra những hình thức chính thể cần phải có. Vì vậy, Rousseau chỉ đề cập lịch sử chính trị của loài người một cách khái quát nhất, còn lại tập trung bàn đến vấn đề phải tổ chức lại xã hội như thế nào. Ông đưa ra những nguyên tắc thiết lập một xã hội lý tưởng bằng các khế ước - đó là những luật cơ bản như hiến pháp, luật dân sự, hình sự... mà mọi thành viên trong đó phải tự nguyện tuân theo. Những khế ước đó bảo đảm các quyền lợi của xã hội, của mỗi thành viên như sự tự do, bình đẳng, quyền tư hữu... Sau khi đưa ra những nguyên tắc ấy, Rousseau bàn đến các hình thức chính thể. http://www.thuvienso.info Sau thời kỳ dài của “đêm trường Trung cổ”, nhu cầu về thiết lập một trật tự xã hội mới với nền tảng cơ bản là giải phóng con người, tôn trọng quyền tự do của con người đặt ra hết sức gay gắt... Các nhà tư tưởng khai sáng đã xuất hiện và các ông đã có những công trình triết học, văn học, pháp luật, xã hội học..., nhằm hướng tới xây dựng một xã hội “tự do, bình đẳng, bác ái”. Montesquieu (1689 - 1755) và Rousseau (1712 - 1778) nổi lên với tư cách là hai nhà tư tưởng có những ảnh hưởng rất lớn đến cuộc cách mạng tư sản Pháp nói riêng và nền văn minh thế giới nói chung. Hai tác phẩm: “Bàn về tinh thần pháp luật” (1748) của Montesquieu và “Bàn về khế ước xã hội” (1762) của Rousseau ra đời, trở thành bộ đôi tác phẩm có ý nghĩa khai sáng về quan điểm pháp chế, vạch ra định hướng xây dựng xã hội công dân, nhà nước pháp quyền, mở đường cho tư duy xã hội Pháp đi tới cuộc đại cách mạng tư sản năm 1789. Nhiều quan điểm trong hai tác phẩm này đã trở thành những nguyên tắc pháp lý chi phối sâu sắc đến sự phát triển của nhà nước và pháp luật hiện đại.
Hai tác phẩm ra đời đúng vào thời điểm mà tư tưởng cách tân bị ngăn cản, cấm đoán bởi các thế lực phong kiến hủ bại và thần quyền đương thời. Nhưng các tác giả đã dũng cảm thể hiện thái độ và tinh thần xây dựng tích cực của mình trước hiện thực xã hội. “Bàn về tinh thần pháp luật” đã đề cập và lý giải hàng loạt vấn đề luật học cũng như các khoa học xã hội đương thời; phân tích so sánh các nội dung và bản chất của các thể chế chính trị khác nhau, chỉ ra nhiều điểm hạn chế và tích cực của từng thể chế; bàn về các yếu tố liên quan đến luật, cách soạn thảo luật và ứng dụng luật trong các lĩnh vực xã hội... “Bàn về khế ước xã hội” cũng đề cập những vấn đề nêu trên nhưng đi theo hướng tư duy hoàn toàn khác: Nếu như Montesquieu muốn khám phá cái “trật tự, cái quy luật trong mớ hỗn độn các luật pháp ở mọi xứ sở và mọi thời đại” thì Rousseau lại cố gắng tìm kiếm trong cái “trật tự dân sự có hay không một số quy tắc cai trị chính đáng, vững chắc, biết đối đãi với con người như con người”; nếu như Montesquieu dùng phương pháp quy nạp trên cơ sở khảo sát, phân tích đặc điểm từ tự nhiên đến xã hội và các chính thể để rút ra các nguyên tắc chi phối chúng, thì Rousseau đi từ những nguyên tắc chung để đưa ra những hình thức chính thể cần phải có. Vì vậy, Rousseau chỉ đề cập lịch sử chính trị của loài người một cách khái quát nhất, còn lại tập trung bàn đến vấn đề phải tổ chức lại xã hội như thế nào. Ông đưa ra những nguyên tắc thiết lập một xã hội lý tưởng bằng các khế ước - đó là những luật cơ bản như hiến pháp, luật dân sự, hình sự... mà mọi thành viên trong đó phải tự nguyện tuân theo. Những khế ước đó bảo đảm các quyền lợi của xã hội, của mỗi thành viên như sự tự do, bình đẳng, quyền tư hữu... Sau khi đưa ra những nguyên tắc ấy, Rousseau bàn đến các hình thức chính thể. Việc mở rộng nghiên cứu những tác phẩm kinh điển về lĩnh vực lập pháp là rất cần thiết đối với toàn thể mọi người quan tâm, đặc biệt là các cán bộ nghiên cứu, giảng dạy khoa học xã hội cũng như cán bộ lãnh đạo Đảng, chính quyền và đoàn thể. Hai tác phẩm: “Bàn về tinh thần pháp luật” và “Bàn về khế ước xã hội” (bản dịch của Hoàng Thanh Đạm) chính là những tư liệu quý phục vụ tốt cho nhu cầu đa dạng của các bạn.

Là một trong những danh tác chính trị thế giới, cuốn sách này vừa tiếp nối dòng chảy liên tục của tư tưởng nhân loại về phạm trù “nhà nước”, “quyền lực” từ thời Hy Lạp - La Mã cổ đại đến thời Phục hưng, vừa góp phần tạo tiền đề trực tiếp cho trào lưu Khai sáng Pháp thế kỷ XVIII và ghi dấu ấn rõ nét trong tư duy và hành động của các nhà lập quốc Mỹ sau này. Triết gia người Anh John Locke (1632 - 1704) là một trong những tên tuổi nổi bật nhất trong lịch sử tư tưởng phương Tây thế kỷ XVII và được xem là một trong những cội nguồn tri thức của phong trào Khai sáng của châu Âu. Cuốn sách “Khảo luận thứ hai về chính quyền” của Locke là một chuyên luận về nguồn gốc, phạm vi và mục đích chân chính của chính quyền dân sự. Với tác phẩm này, Locke đã trực tiếp đưa ra học thuyết của mình về nhà nước.
Nguồn gốc của chính quyền. Những luận giải của Locke về sự ra đời của nhà nước - chính quyền gợi sự liên tưởng đến một triết gia khác của Anh là Thomas Hobbes (1588 - 1679). Nếu như Thomas Hobbes quan niệm “nhân chi sơ tính bản ác” thì John Locke lại cho rằng bản tính của con người được quyết định bởi lý trí và lòng bao dung. Tuy nhiên, cả hai tác giả này đều lý giải sự xuất hiện của nhà nước trên cơ sở một giao ước chung của cộng đồng - khế ước xã hội.

qqqDịch là một nghề nghiệp. Nghề dịch có hai ngành khác nhau rất cơ bản. Đó là dịch viết hay biên dịch (translation) và dịch nói hay phiên dịch (interpreting). Nếu chúng ta cho rằng dịch viết phải tầm chương trích cú thì dịch nói phải đủ ý và rõ ràng. Mỗi loại dịch lại có những tiêu chí riêng đối với người dịch. Chẳng hạn dịch viết đòi hỏi người biên dịch (translator) có khả năng khai thác tư liệu một cách phong phú và đa dạng thì dịch nói đòi hỏi người phiên dịch (interpreter) phải có trí nhớ tốt (good memory), đặc biệt là trí nhớ tạm thời (short term memory). Đồng thời mỗi loại dịch lại có một số kỹ thuật riêng để thực hiện nhiệm vụ dịch thuật.
Ngành phiên dịch có hai loại hình khá khác biệt: dịch đuổi (consecutive interpreting) và dịch song song (simultaneous interpreting). Trong loại hình dịch đuổi, phiên dịch đợi cho diễn giả (speaker) nói hết một đoạn ngắn đủ nghĩa, dừng lại, rồi mới bắt đầu dịch. Cứ như vậy phiên dịch "đuổi" theo diễn giả cho đến hết cuộc nói chuyện.
Trong loại hình dịch song song, phiên dịch được trang bị tai nghe (headphone) để nghe diễn giả nói, nói đến đâu phiên dịch dịch đến đó. Đại biểu cũng thường dùng tai nghe (headphone, earphone) để nghe lời dịch, thông qua một hệ thống thiết bị dịch song song (interpreting facilities). Theo cách dịch song song phiên dịch có khi chỉ đi sau diễn giả một câu.
